Lease Agreement

Definitions

“Supplier” refers to Eventist Hire.
“Leasee” refers to the individual or business entering into the hire agreement with Eventist Hire.


Terms and Conditions

1. Contract Acceptance

The Leasee enters into a binding agreement with Eventist Hire upon making a booking and acknowledges acceptance of all terms and conditions herein.


2. Payment Terms

  • The individual or company making the booking is fully responsible for all associated payments.

  • Payment must be made prior to the event via EFT, Visa, Mastercard, or cash.

  • Cash payments on the event day must be pre-approved by the Supplier. The Leasee or their authorised representative must be present with correct payment at delivery.

  • If cash payment is not available at the agreed delivery time, Eventist Hire may refuse delivery or charge the credit card provided at booking.


3. Bond Requirements

  • A refundable bond may be required and must be paid via EFT at least 7 days prior to the event, unless cash bond arrangements have been approved.

  • The bond is refunded once equipment is collected and inspected.

  • Any damage, loss, vandalism, or cleaning charges may be deducted from the bond.


4. Credit Card Authority

By making a booking, the Leasee authorises Eventist Hire to charge their credit card for:

  • Damaged or missing equipment

  • Theft

  • Excessive cleaning

  • Inability to access hired items at the agreed pickup time

  • Cancellation fees


5. Deposits, Cancellations & Refunds

  • A 50% deposit is required to confirm all bookings.

  • Full payment must be received 7 days prior to the event. Failure to pay may result in cancellation with no refund.

Refund Policy:

  • Cancellations more than 7 days before the event: full refund of deposit.

  • Cancellations 7 days to 48 hours before the event: deposit is non-refundable.

  • Cancellations within 48 hours of the event: 100% cancellation fee applies.

  • Removing items from an existing order counts as a partial cancellation and incurs:

    • 50% fee if more than 48 hours before event

    • 100% fee if within 48 hours

  • COVID-19 related cancellations will be assessed case by case. A credit may be issued if a minimum of 48 hours’ notice is provided.

  • Credits issued must be used within 6 months of the original booking date.

    5A. Returns Policy

    Eventist Hire is a hire-service business.
    We do not accept returns or exchanges for change of mind, incorrect selection, or event cancellation outside of our stated refund terms.

    All bookings are final once confirmed.


    5B. Faulty or Missing Items

    If any item is found to be faulty, damaged, or missing at the time of delivery, the Leasee must notify Eventist Hire immediately.

    Eventist Hire will, at its discretion:

    • Replace the item with the same or similar item, or

    • Issue a refund for that specific item if a replacement is not available

    This applies only to faults identified at delivery, not damage occurring after setup or during the event.


6. Price Changes

Eventist Hire reserves the right to adjust pricing, specials, and fees at any time without notice.


7. Weather, Safety & Delivery Restrictions

Eventist Hire may reschedule or delay delivery if conditions are unsafe, including but not limited to:

  • Torrential rain

  • Flooding

  • High winds

  • Hail

  • Extreme storms

  • Restricted access or emergency zones

If delivery cannot occur on the event day due to safety concerns, the Supplier will deliver at the next available opportunity.
If the event cannot be rescheduled, a 50% credit of the original booking value may be issued.


8. Hire Duration

  • Standard hire duration is one day, unless otherwise agreed in writing.

  • If equipment cannot be collected at the agreed time due to Leasee unavailability, additional daily hire fees may apply.


9. Responsibility for Equipment

  • The Leasee is fully responsible for hired equipment from the moment it is delivered until it is collected.

  • Responsibility includes:

    • Loss

    • Theft

    • Damage

    • Vandalism

    • Weather-related damage

  • No refunds are issued for equipment damaged by weather or misuse.


10. Delivery Requirements

  • The Leasee must ensure someone is present at the allocated delivery time.

  • Failure to be present may result in re-delivery fees.

  • Standard delivery hours are 8am–4pm, seven days per week (excluding public holidays), unless otherwise arranged.

  • Requests for exact delivery times may incur additional fees.

  • Same-day pickups also incur additional fees.


11. Delivery Access

Delivery is to ground level only unless otherwise arranged. Extra charges apply if:

  • Delivery location is more than 10 metres from vehicle access

  • Delivery requires stairs, steep slopes, or building level access

Failure to disclose these conditions may result in extra charges or refusal to deliver.


12. Setup Services

  • Setup services must be pre-booked.

  • Eventist Hire provides setup only for items hired from Eventist Hire.

  • All other styling or setup not supplied by us is the responsibility of the Leasee.


13. Safe Use of Equipment

The Leasee acknowledges:

  • They understand correct operation and handling of hired equipment

  • They assume full responsibility for safety

  • Eventist Hire is not liable for injury caused during use, movement, or setup of equipment


14. Ownership

All equipment remains the property of Eventist Hire at all times.
This agreement cannot be transferred to another party without written consent.


15. Inspection Upon Delivery

The Leasee must inspect all items at delivery and notify Eventist Hire immediately of:

  • Missing items

  • Damaged items

  • Items unfit for use

If no notification is made, the equipment is deemed delivered in acceptable condition.


16. No Warranty

Eventist Hire does not warrant equipment suitability for any particular purpose and accepts no responsibility for damages caused by the use of the equipment.


17. Email Communication

By providing an email address, the Leasee agrees to receive occasional promotional offers unless they opt out at the time of booking.


18. Governing Law

This agreement is governed by the laws of Victoria, Australia.


19. Indemnity

The Leasee agrees to indemnify and hold harmless Eventist Hire from all claims, damages, losses, penalties, expenses, legal fees, or third-party actions arising from use of the equipment.


20. Amendments

Only Eventist Hire may amend these Terms & Conditions.
Any additional agreements must be written and signed by both parties.
Verbal agreements are not binding.


21. Severability & Waiver

If any clause is deemed invalid, only that specific clause is affected.
A waiver by either party does not constitute a continuing waiver unless explicitly stated.
